قررت محكمة العدل الأوروبية تسهيل عملية إعادة اللاجئين إلى دول الاتحاد الأوروبي الأخرى.
وفقا لهذا الاتجاه فإذا كان قد تم تقديم طلب اللجوء الأولي هناك، فإن بلد الإقامة الحالي لا يتعين عليه عادة التحقق مما إذا كان اللاجئ مهددًا بالترحيل إلى بلده الأصلي أم لا، حسبما قضت به محكمة العدل الأوروبية نهاية هذا الأسبوع، في لوكسمبورغ.
وتقدم العديد من طالبي اللجوء من أفغانستان والعراق وباكستان بطلبات للحصول على اللجوء في إيطاليا. وسبق لهم أن قدموا طلبات لجوء في دول أخرى بالاتحاد الأوروبي، وكان أحدهم قد تقدم بطلبه للجوء في ألمانيا.
ووفقاً لقانون الاتحاد الأوروبي، تكون هذه الدول مسؤولة أيضاً عن إجراءات اللجوء. ولذلك وافقت ألمانيا والدول الأخرى على إعادة اللاجئين من إيطاليا.

ورفع اللاجئون دعاوى أمام المحاكم الإيطالية ضد قرارات ترحيلهم من إيطاليا إلى الدول الأوربية. بدورها قدمت المحاكم المسؤولة في إيطاليا عدة أسئلة إلى محكمة العدل الأوروبية في هذا الصدد، لتوضيح الأمر وفق القوانين الأوروبية.
وقررت المحكمة الأوروبية بأن إيطاليا ليست مضطرة للتحقق ولا يُسمح لها بالتحقق أيضا دون وجود “ظروف استثنائية” مما إذا كانت الدولة التي تم تقديم الطلب الأولي فيها سترفض حماية اللاجئين وبالتالي ستعيدهم إلى بلدهم الأصلي. وكقاعدة عامة، يتعين على دول الاتحاد الأوروبي أن تثق في بعضها البعض فيما يتصل باحترام قانون الاتحاد الأوروبي والحقوق الأساسية.
وشدد قضاة محكمة العدل الأوروبية في لوكسمبورغ على أن “حقيقة أن الدول الأعضاء لديها آراء مختلفة فيما يتعلق بتفسير المتطلبات الموضوعية للحماية الدولية، لا يعني ذلك أن هناك نقاط ضعف منهجية.
